Asbestos Worked on mesothelioma and lung cancer cases, representing successor corporation to local company which distributed asbestos-containing products in the 1960s and 1970s. Numerous settlements and summary judgments.
Negligence/Products Liability Worked on a three month trial on claims of negligence and products liability due to a fall from a ladder, involving successor corporation liability, two different companies’ bankruptcies, and two appeals.
Appellate Briefing Drafted a number of Appellate briefs both for Hawaii Appellate Courts and the Ninth Circuit Court of Appeals, including an appeal in the area of real estate supporting dismissal and summary judgment in favor of attorney who acted as a real estate attorney in underlying litigation; a number of appeals relating to medical malpractice trials with published decisions listed below and unpublished decisions including Taylor v. Winston, 112 Hawai'i 148, 144 P.3d 596 (App. 2006) (unpublished decision); Li v. Estate of Pershing, 103 Hawai'i 180, 80 P.3d 1001 (2003)(unpublished decision); and appeal related to an alleged assault in a downtown Honolulu office building.
CERCLA Litigated case involving Comprehensive Environmental Response, Compensation and Liability, 42 USC Section 9607 and state law counterpart, which resulted in settlement. A published ruling in case was Servco Pacific, Inc. v. Dods,193 F.Supp.2d 1183 (D.Haw. 2002),
Trust Litigation disputes between beneficiaries of a Hawaii Trust, which resulted in appellate mediation and settlement.
